1. Scope and agreement
These Terms govern use of the Layaswarna Android app (in.berhampore.dhar.layaswarna) and its official informational pages. The publisher is the developer identified on the app's Google Play listing. By using the app, you acknowledge the notices on this page and the separate Privacy Policy and Sound Safety Notice. Nothing here removes any statutory rights that cannot lawfully be excluded.
2. What the app provides
The app generates audible signals within bounded configuration ranges, offers example sound profiles and modern symbolic chakra-tone associations, and provides short sessions. Profiles, descriptions and frequency values are experimental or illustrative. Frequencies displayed in software do not establish actual acoustic frequency response, sound pressure level, biological effects or product performance on your device.
3. User responsibilities
- Use the app cautiously, at a comfortable low volume and only while present and attentive. Keep the device away from ears and other people's personal space.
- Stop immediately if anyone nearby or any animal shows discomfort or distress. Do not use the app to punish, scare, drive away, herd or otherwise harm animals or people.
- Do not use the app as a substitute for licensed medical, hearing, sleep, pest-management, animal-care or emergency services.
- Keep the app out of unsupervised use by children. Comply with local noise, nuisance, privacy, wildlife and animal-welfare rules.
- Do not bypass safety controls, modify the app to extend sessions or connect prohibited audio routes. Physical audio output differs across hardware.
4. Limitations and no promises of results
To the extent permitted by applicable law, the app and website are provided “as is” and “as available” without guarantees of uninterrupted operation, suitability for a particular purpose, pest-repellent efficacy, relaxation, chakra-related physiological effects, medical benefits, or compatibility with every phone or speaker. We do not guarantee that the app is free of all defects or that an audio level will be safe in every environment.
5. Risk of sound exposure
Sound can cause annoyance or discomfort and may create hearing risks depending on the phone, volume, distance, environment and listener. The app's digital-amplitude cap and device volume gate are software safeguards, not calibrated sound-pressure measurements or warranties of safety. The safety feature may behave differently across devices and system versions. Use at your own discretion, subject to the protections of applicable law.
6. Limitation of liability
To the maximum extent permitted by law, the publisher is not responsible for indirect, incidental, consequential, special, or punitive losses (such as loss of data, business, opportunities or expected benefits) arising from use of the app or website. To the extent legally permitted, the publisher's aggregate liability for claims relating to the app shall not exceed the greater of (a) the amount the claimant paid directly for the app during the preceding 12 months or (b) INR 1,000.
These limitations do not exclude or restrict liability where doing so would be unlawful, including statutory consumer rights or liability that cannot be excluded for personal injury, fraud, wilful misconduct, or other non-excludable legal duties. The publisher does not purport to prevent users from submitting complaints, approaching regulators or bringing lawful claims before courts or consumer authorities.
7. Changes, availability and discontinuation
We may correct defects, modify experimental profiles, remove unsafe features, update notices or stop offering the free app. Where required, material changes will be disclosed. You are responsible for maintaining your own local preset information; it may be lost on app removal, device changes or data clearing.
8. Intellectual property and third parties
The app's original visual design, code and documentation may be protected by intellectual-property law, subject to any open-source licences stated in the relevant materials. Google Play and Android are operated by third parties under their own terms. Links to third-party information do not amount to endorsement.
9. Applicable law and disputes
Subject to any mandatory consumer-protection and other applicable rules, these Terms are interpreted under the laws of India. We encourage users to contact us first so concerns can be investigated and resolved where possible. Nothing here limits access to competent courts, consumer commissions, regulators or statutory dispute-resolution mechanisms.
